The remediation notices resulting from FENZ’s failure to accurately calculate leave payments over many years are now being sent out to members.

Members are advised it is not in your interests to sign a form consenting FENZ to deduct any monies they say you owe from the remediation payment.

  • FENZ is yet to demonstrate to the NZPFU that they have a right to seek repayment of any claimed overpayments.  There are protections and obligations in accordance with the Wages Protection Act which may mean FENZ has no legal ability to recover overpayments in these circumstances.
  • FENZ has yet to undertake the calculations from 2024 to present.  It is highly likely there will need to be further remediation and therefore could owe the members more money than identified through this remediation.
  • The letters will only provide totals. Members are advised to request a full breakdown of the calculations for the totals they provide.  With technical calculations on such a large scale there are likely to be errors.  Regardless, it is not in your interest to consent to deductions.
