The applications for an Interim Injunction restraining these appointments from the Union and the Chiefs and Deputies Society was heard on Friday 23 May commencing at 3pm.

Around four and a half hours later, the Employment Relations Authority member hearing the applications determined to reject the applications. He advised that reasons for his determination would be provided later.

Both counsel for the Union and the Chiefs & Deputies Society advised that this determination would be appealed to the Employment Court forthwith.

Counsel advised they now sought an Interim Injunction to protect the status quo until the appeal could be heard.

This application was heard by the Employment Relations Authority on Saturday 24 May 2008.

The outcome of this hearing is an order that in effect provides:

  • An Interim Injunction was granted preventing the appointments proceeding;

  • The Union and the Chiefs & Deputies Society to file in the Employment Court by 2.00pm on Monday 26 May;

  • The Interim Injunction to remain until Wednesday 4 June or otherwise ordered by the Employment Court;

  • The Union to lodge $3000 into the Employment Court for any loss, if any, Mr. Ditmar and Mr.Boere may suffer between 26 May and 4 June, if the appeal to the Employment Court is not successful.

It is hoped the appeal will be heard by the Employment Court this week.
