ERA RULES FENZ BREACHED GOOD FAITH AND NZPFU AND PSA COLLECTIVE AGREEMENTS BY FAILING TO CONSULT

In November 2025, FENZ dropped a 260-page document that affected more than 700 positions and more than hundreds of roles to be disestablished.

The NZPFU and PSA filed an urgent action last year in a bid to stop the restructure claiming FENZ had failed to consult in accordance with the provisions of the collective agreement.

Today the Employment Relations Authority (ERA) released its decision finding that FENZ failed to consult in accordance with the collective agreement provisions, that it failed to consult on whether change should occur or at a time when the Unions could influence an outcome, and failed to consult in a manner driven by a desire to reach consensus. It also found FENZ’s conduct breached the obligation of good faith.

FENZ NOW REFUSING TO PROVIDE A NEW OFFER

Yesterday the ERA contacted the NZPFU requesting our availability for facilitated bargaining on the 30^th and 31^st March 2026.  There had obviously been previous communications between the ERA and FENZ (that we had not been copied into) and despite requesting that correspondence we did not receive it.

The NZPFU accepted facilitation on the basis that FENZ would provide a new offer that CE Kerry Gregory had earlier told the Union it was being worked on.

NZPFU AND FENZ HEAD BACK TO BARGAINING

Today the NZPFU accepted two days of facilitated bargaining on the basis that FENZ brings an enhanced offer to the table.

We were contacted by the Employment Relations Authority today offering the 30^th and 31^st March for facilitated bargaining. The NZPFU has consistently been calling for bargaining to recommence as we cannot resolve this dispute unless we are around the table genuinely negotiating.

WHERE IS THE NEW OFFER FENZ?

NZPFU members walk off the job for one hour from 12 noon today with no bargaining in sight.

In February the NZPFU wrote FENZ with the outcome of strike ballots taken during the national round of membership meetings in February.  We were asking for bargaining to recommence and proposed a process for tackling the big issues in particular. 

NZPFU MEMBERS STAUNCHLY TAKE TO THE STREETS DESPITE ATTACKS ON THEIR WAGES

NZPFU members will be out in force for one hour from 12 noon tomorrow as they continue their strike action in a bid for a fair and reasonable collective agreement.

FENZ BLOCKS NZPFU EMAILS AND PUTS PRESSURE ON VOLUNTEERS TO STOP SUPPORTING THE NZPFU

Yesterday, the NZPFU notified our members and supporters that FENZ was spending between $70,000 and $99,000 a week on a media campaign against the NZPFU one-hour strikes.

FENZ INSISTS NZPFU DROPS ALL INDUSTRIAL ACTION AND FUTURE ACTION BEFORE ANY RETURN TO BARGAINING

The NZPFU FENZ bargaining is currently in abeyance with no bargaining dates agreed.

The parties met for facilitated bargaining on 7 occasions with the last session on the 13th February 2026. Facilitation has been adjourned and, from the NZPFU’s perspective, that process was not successful.

FENZ spends more than a firefighter’s annual salary for a few days of media advertising – weekly!

Since the NZPFU one-hour strikes started in October 2025, FENZ has been burning through $70,000 to $99,000 a week on a media campaign against the NZPFU one-hour strikes.

FENZ management have exposed their true colours in their latest salvo against striking NZPFU members,  including striking firefighters and 111 emergency call centre dispatchers.

NZPFU ISSUES NOTICE OF NEW INDUSTRIAL ACTION AND PROPOSES BARGAINING PROCESS TO FENZ

The NZPFU has issued a notice of new industrial action commencing on 23 March 2026.

The new industrial action does not affect emergency response and is primarily bans on administrative and other functions and tasks that is unlikely to be noticed by the general public.

NZPFU now striking twice a week

The NZPFU will hold national strikes for one hour from 12 noon this Friday the 13^th and on Monday 16^th February 2026.

The NZPFU has now escalated the strike action to two one-hour strikes per week in a bid to put pressure on FENZ to change their position. As is usual practice the National Committee meets every week to discuss the pending Friday and Monday strikes and the National Committee has determined this Friday and Monday the 16^th will proceed.

NZPFU MEMBERSHIP MEETINGS IN FEBRUARY 2026

The NZPFU and FENZ were in facilitated bargaining this week. At the close of that bargaining FENZ agreed to provide specific information we have requested which we say is necessary for us to have a full understanding of what FENZ claims is fiscal restrictions by Treasury, Government and the Public Service and what is FENZ’s determined limitations.

We deny the allegations and the legal action will be defended.

Contrary to the allegations, career firefighters and volunteer firefighters have a strong working relationship and we will continue to foster that relationship.

Update on NZPFU, PSA bid to require FENZ to undertake genuine consultation on any need for restructure

The NZPFU and PSA met with FENZ today in mediation resulting from our joint application to the Employment Relations Authority regarding the failure of FENZ to consult on the restructuring where FENZ plans to slash jobs and significantly change risk management and operational structures.

FACILITATED BARGAINING SET DOWN FOR NEXT WEEK

The Employment Relations Authority has set down facilitated bargaining for the 9^th and 10^th December – next Tuesday and Wednesday – in Wellington

Thursday we are in mediation on the joint application we filed with the PSA on FENZ’s failure to consult with the Unions on the restructure that will slash 160 jobs.

NZPFU MEMBERS TO STRIKE FOR ONE HOUR TODAY

Approximately 2,000 NZPFU members will strike for one full hour from 12 noon today.

Notices have also been issued for the 12^th and 19^th December 2025.

These strikes could be avoided if FENZ agreed to meet and progress the bargaining. The notified strikes for the next two weeks will be dependent on FENZ’s attitude to getting bargaining going again.

NZPFU congratulates PPTA on settlement

PPTA Secondary Teachers have accepted a pay offer of 2.5 and 2.1 over a 24-month contract.

EMPLOYMENT RELATIONS AUTHORITY ORDERS FACILIATED BARGAINING

Today, the Employment Relations Authority has issued a determination sending FENZ and the NZPFU to facilitated bargaining on the basis of protracted bargaining.

FENZ has refused to meet or agree to bargaining dates pending that decision, despite the process not precluding the parties continuing to meet to try and resolve the issues.

The NZPFU is taking legal advice on the decision.

NZPFU MEMBERS HAVE NO OPTION BUT TO WALK OFF THE JOB AGAIN TODAY

About 2000 NZPFU members walk off the job for one hour today from midday in 19 cities and towns in a bid to try and get FENZ and the Government to act to address the dire state of the fire service.

BARGAINING UPDATE

FENZ’s application to send the parties to facilitation was heard in the Employment Relations Authority yesterday.

NZPFU TO STRIKE ON FRIDAY

The NZPFU and FENZ have been in bargaining for the past day and a half.

Yesterday the NZPFU put up an option resulting from the information we received the week before that FENZ would not agree to.

NZPFU AND PSA FILE JOINT LEGAL ACTION AGAINST FENZ’S RESTRUCTURE

The NZPFU and PSA have filed legal action against Fire and Emergency New Zealand’s failure to consult on the botched restructuring proposal, released last week.

When FENZ pre-warned that a restructuring document was to be released (without any information about the nature, scope or content of that restructure), the NZPFU wrote to Kerry Gregory reminding him of the obligation to consult in accordance with the NZPFU FENZ collective agreement, which does not limit consultation to the consequences of a proposed change, or to numbers, but also includes consultation on whether change should occur and the reasoning behind that change.

FENZ’S APPLICATION FOR URGENT FACILIATION ADJOURNED

Today the Employment Relations Authority adjourned the hearing of FENZ’s urgent application for facilitation determining that the Authority was best served to allow bargaining to continue as planned next week and then to have updated evidence on the status of that bargaining.

FENZ filed for their urgent application for facilitation on the 7^th October 2025.

That application was to be heard today.

NZPFU calls off tomorrow's strike action

The NZPFU has called off tomorrow's strike action.

The NZPFU and FENZ are back in bargaining Monday and Tuesday. The Union has received new information that is pivotal to the bargaining.

MORE NZPFU MEMBERS ASKED TO RESTRUCTURE MEETINGS WITH NO INFORMATION ON THE CHANGES

The NZPFU has been informed that other staff including those working in health, safety and wellbeing team have also been notified of meetings to discuss the impacts on their role.

Please text or email your Local secretary the time and date of such meetings and we will make sure Union representatives are there.

FENZ’s conduct of this process is appalling and we will be challenging it.

Possible further asbestos risk

Members are advised that due to asbestos being identified in one sample bulk air supply tank  that was used prior to 2023 to fill Breathing Apparatus (BA) cylinders at Auckland City Station, we are concerned about a possible risk of asbestos contamination in breathing apparatus cylinders that were filled from that air tank.

FENZ ASKS STAFF TO RESTRUCTURE MEETINGS WITH NO INFORMATION ON THE CHANGES

At 6pm today (Monday 10^th November) FENZ Deputy National Commander Megan Stiffler sent out an email to staff in the Community Resilience and Risk Reduction teams inviting them to a meeting on Wednesday to discuss proposed restructuring and “what it could mean for your roles”.

The staff have not been provided with any information at all about the proposal so they are naturally thinking the worst case scenario – FENZ wants them gone.

It was refreshing to be able to have intelligent and thoughtful discussions which was in stark contrast to the first 12 months of bargaining where some FENZ representatives were disinterested, disrespectful and out of their depth.

FENZ’S APPLICATION FOR FACILITATION HEADING TO MEDIATION

Yesterday afternoon (Monday) the Employment Relations Authority (ERA) set down a timetable for FENZ’s urgent application for facilitation of bargaining. The ERA member has directed parties to try and resolve the issue of facilitation in mediation to be held before 28 October 2025. The mediation is solely about FENZ’s application for facilitation and if the parties resolve the matter at mediation FENZ’s application for facilitation will be withdrawn.

Auckland City Fire Station – Asbestos Testing and Next Steps

The NZPFU Auckland Local is providing this update to ensure members have clear and accurate information regarding the recent asbestos testing and subsequent actions at Auckland City Fire Station.

NZPFU Strike Event Locations

Come and support our strike action – be there before 12 noon start and picket with the NZPFU members for an hour. Approximately 2,000 members are walking away from fire stations and workplaces for one hour from 12 noon on 17 October 2025.

FENZ is refusing to meet to bargain with the NZPFU or provide a new offer they say they have. We have no option but to take strike action.

FENZ FAILS AUCKLAND CITY FIRE STATION STAFF AGAIN WITH ASBESTOS EXPOSURE

The NZPFU will be seeking an independent inquiry into how firefighters and other FENZ staff were again exposed to asbestos at Auckland City Station. Our members should not be repeatedly, and avoidably, contaminated in their workplace.

FENZ PUT UNIFORMS AHEAD OF FIRE SAFETY

FENZ management have issued instructions that firefighters wearing NZPFU t-shirts instead of FENZ t-shirts are not to undertake usual fire safety duties including installing smoke alarms and school visits.

This is a shockingly petty call by FENZ management to try and pressure firefighters at the expense of necessary fire safety programmes that particularly benefit children and the elderly.

An election for the Timaru Local President position shall be conducted by electronic voting commencing at 0900 (9am) Monday 6 October 2025 and closes 1700 (5pm) Friday 17 October 2025.

FENZ USES NOTIFED STRIKE AS AN EXCUSE TO WALK AWAY FROM BARGAINING - AGAIN

FENZ has notified the NZPFU that it will not bargain with the NZPFU and will file for facilitation in the Employment Relations Authority unless we withdraw the notice for the one-hour stoppage on the 17^th October. FENZ says it will not provide any new offer while the strike notice remains.

TAURANGA KAWERAU AGREEMENT BALLOT RESULTS

Tauranga and Kawerau Local members were balloted on a new agreement to replace the 2007 Tauranga Kawerau Amalgamation agreement.

NZPFU NOTIFIES FENZ OF INTENTION TO STRIKE ON 17 OCTOBER

Today the NZPFU gave FENZ notice of a one-hour full strike/stoppage from noon to 1pm on 17 October 2025.

FENZ UNLAWFULLY REFUSING TO PAY PARENTAL LEAVE PAYMENTS

FENZ has responded to NZPFU members’ claims for the outstanding parental leave payments on the basis they will appeal the ERA decision.

In 2007 the NZPFU and NZFS signed the attached Tauranga Kawerau Amalgamation document grandparenting conditions for those employed in the district and setting out transfers and travel terms and conditions.

In recent years the Tauranga and Kawerau Locals have been meeting with FENZ management to resolve matters affected by the 2007 agreement and the attached 2025 document has been drafted as a result.

At the close of the notified nominations period one nomination for the position of Timaru Local Secretary has been received.

I therefore declare Jeremy Gaskin as Timaru Local Secretary.

As a result there is the Timaru Local President position is now vacant.

PAY EQUITY AND WOMEN IN THE WORKFORCE

NZPFU members are encouraged to participate in events organised around the country on Saturday, 20 September to protest the gutting of the pay equity legislation that the National-lead Government has claimed saved $13 billion and therefore taken from the wages of women workers.

FIREFIGHTERS WELFARE SOCIETY SURVEY

The NZ Firefighters Welfare Society is conducting a survey to understand the types of support firefighters and fire agency personnel need.

NZPFU WINS PARENTAL LEAVE INCENTIVE PAYMENT CASE

The Employment Relations Authority has agreed that the parental leave incentive payment for early return from parental leave is payable whether the NZPFU member sought 12 months leave or less.

NZPFU AND FENZ CONTINUE TO BARGAIN

Progress has been made in bargaining with FENZ now finding ways to agree to some NZPFU claims and undertaking to re-consider others. The NZPFU also moved on some matters.

Mike will be known by many of our members as a firefighter for many years, before transferring to Waitemata District as a Volunteer Support Officer.

Today, Te Pati Maori co-leader Debbie Ngarewa-Packer sent the attached letter of support and copied in the Minister for Internal Affairs Brooke van Velden. 

NZPFU ORGANISES ONGOING BARGAINING

The NZPFU has made the practical preparations for bargaining to continue as planned on the 3^rd and 4^th September.

FENZ walked away from the bargaining during the August session unilaterally declaring that bargaining had ended.  FENZ then sought mediation.  The NZPFU has refused mediation as it is our strong view that bargaining has not concluded.  In fact, Workplace Relations Manager Michael Stephenson admitted in recent correspondence that there had been some productive discussions during the last day we met in bargaining.

NZPFU WANT FENZ TO COME BACK TO THE TABLE WITH THOSE WHO WANT TO MAKE POSITIVE CHANGE!

FENZ Workplace Relations Manager Michael Stevenson who leads the FENZ bargaining team contacted the mediation services but did not have the courtesy to include the NZPFU in his request for mediation. Hardly the efforts of someone who wants to achieve a positive outcome. We believe he misled the mediation service by claiming both parties had agreed to mediation.

FENZ ORCHESTRATED BREAKDOWN IN BARGAINING AND IS SPREADING MISINFORMATION

This week, FENZ abandoned the bargaining by unilaterally declaring that bargaining had run its course. Their behaviour has demonstrated that FENZ was just biding its time, only providing an offer in June which did not reflect their own claims. Why? So that they could claim they have made savings by refusing any form of backdating on any matters including wage increases.

FENZ WALKS AWAY FROM BARGAINING

Bargaining recommenced yesterday and today with four more bargaining days previously agreed in September and October.

But this afternoon FENZ collapsed the talks and walked away.

Kawerau Local Vice President Election Result

NZPFU ISSUES STRIKE ACTION NOTICES

The NZPFU has today issued FENZ notices of strike action that will commence from 0001 hours on the 11 August 2025.   

Members are advised not to take any action until 0001 hours on 11 August and then only to take the actions listed in the two strike notices.

Income Protection and Life Insurance Reimbursements Process for 2024-2025 year

This information ONLY APPLIES to any NZPFU member who has income protection and/or life insurance other than the NZPFU Protect policy, or is a member that is paying their own NZPFU Protect Income Protection Insurance premiums because their role is not covered by the 2021-2024 NZPFU collective employment agreement.  

99% VOTE TO REJECT FENZ’S OFFER

NZPFU members have sent a strong message to FENZ that they will not be accepting the disgraceful offer and have overwhelmingly empowered the Union to bring on industrial action including strikes.

Auckland Local Committee Declaration

The NZPFU Conference in 2022 agreed to a Rule change that provided that the Auckland Local could have a committee of 20 including the three Offices of Local President, Secretary and Vice President. The recent elections of the Auckland Local President and Vice President impacted on the number of nominees for the Auckland Local Committee resulting in the Local Committee now being declared.

NZPFU MEMBERSHIP MEETINGS SCHEDULE [UPDATED]

The NZPFU will be holding membership meetings in July to update on bargaining and conduct any ballots the National Committee thinks necessary.

Retirement of Senior Station Officer Sulu Devoe

After 47 years of dedicated service, Senior Station Officer Sulu Devoe has made the decision to retire. Sulu has been a strong advocate for NZPFU members’ rights and terms and conditions of employment. He would always put firefighter safety and wellbeing front and centre, never failing to raise concerns with Fire and Emergency Management, sometimes ruffling feathers in the process.

NZPFU GIVES FENZ NOTICE OF RIGHT TO DEPLOY PARNELL 255

Since the last NZPFU notice Auckland Local representatives have met with District Manager Vaughan Mackereth to discuss his direction not to deploy the aerial appliance Parnell 255 unless confirmed fire.

Mr Mackereth refused to withdraw his instruction, threatened industrial action for those that did not comply with his instruction and refused to other alternatives to address aspects of the health and safety implications of his instruction.

Today the NZPFU notified FENZ that Officers had the right on health and safety grounds to deploy the heavy aerial in accordance of their training and experience, regardless of confirmed fire.

AUCKLAND HEAVY AERIAL – PARNELL 255

Members will be aware of District Manager Mackereth's instruction to all staff to restrict Parnell’s aerial appliance to respond to confirmed fires only, copied below.

This instruction was issued without genuine consultation with the Auckland Local and highlights the disarray and crisis that Fire and Emergencies fleet is in. Despite the organisation saying that their fleet is well maintained and regularly serviced, once again reality proves the complete opposite,  with this decision impacting the safety and well-being of firefighters and the public.

PUBLIC SERVICE COMMISSION'S DAMNING REPORT INTO FENZ COMPLAINT PROCESSES QUIETLY APPEARS ON FENZ WEBSITE

A new report was quietly added to the FENZ website today without the usual press releases and mass email notifications that previous reviews into complaint processes has enjoyed.  It is a damning report of a Public Service Commission inquiry into the handling of complaints made by a volunteer firefighter against volunteer leaders and management.

Near Disaster on the North Shore

Members will no doubt be aware of the major 5th Alarm fire that broke out last night on the North Shore. This fire had widespread impacts to people across Tamaki Makaurau with several Emergency Alerts having to be made. Additionally, our thoughts go out the local community, including the owner, tenants, and staff of the businesses impacted.

WORKERS MEMORIAL DAY APRIL 28

Occupational disease is the primary killer of firefighters globally and self-harm resulting from mental health issues directly attributed to the workplace is sadly prevalent.

Off-duty or on-break NZPFU members are encouraged to attend these events as we continue the decades long battle to have firefighters occupational disease recognised so that firefighters and their families are supported in their greatest time of need.

It is with deep sadness that we acknowledge the passing of Senior Firefighter Carl Whiten, who has left us after a courageous battle with cancer. Carl was a dedicated firefighter of the Christchurch Brigade, whose unwavering commitment and service profoundly impacted the lives of countless people across Ōtautahi and beyond.

BE WARY OF FENZ-PROMOTED SURVEYS

The NZPFU has been notified of recent “urgent” requests for participation in surveys by FENZ. 

The NZPFU notifies members that it is not in their interests to participate in any survey where the NZPFU has not had the necessary information or involvement to clarify the purpose and scope of the survey, veracity of the methodology including selection of participants and how data will be analysed, or protections of confidential information/anonymity including who has access to the data/information and how it will be stored and used.

Major Fire Causes Widespread Disruption to Auckland Fleet

Members will no doubt be aware of Wednesday's major fire in a scrapyard in Papakura. Whilst the cause of this fire is still under investigation what is known is that the impacts of it were widespread right across Auckland.

Return to Work Duties

We have been told that staff wanting to do Return to Work Duties will have to do them at District HQ and they do not intend to reimburse your travel costs, “you are getting an enhanced pay and you can fund your own travel”. We have since got an agreement that the travel distance reimbursement will be paid for travel to District HQ.

Union calls for Operational Review into Devastating House Fire

Following a devastating house fire in Milldale north of Auckland yesterday the Local has written to the Acting National Commander formally asking for Fire and Emergency to undertake an operational review.

FENZ REVIEW OF STATION GYMS AND LINES RESCUE RESOURCING

The NZPFU has been notified that Stations and Districts are being asked to provide information on the numbers of those that use the gyms, safety standards and rating on equipment on gear not supplied by FENZ and any concerns or observations.

NTM Regarding Travel Time Payments for Training

You need to know that FENZ is refusing to reimburse travel time, to the Auckland Region Training Centre, at the increased rate all other travel has been paid since March 2021.

Serious Concerns About State of Emergency Response Fleet

The Auckland Local has serious concerns about the current and ongoing state of the frontline fleet of fire trucks, rescue tenders, aerial ladder trucks and support vehicles throughout Auckland.

NZPFU DEEPLY CONCERNED ABOUT FENZ’S INTENTIONS FOR THE FUTURE OF EMERGENCY RESPONSE

The NZPFU National Committee has been seeking guarantees from FENZ that it does not have any intention to reduce the scope or change the method of emergency responses currently undertaken, and is not attempting to change the structure in which firefighters are recruited and deployed.

FENZ falls back on old behaviours of excluding NZPFU from important uniform & PPE decisions

Recently, Fire and Emergency New Zealand has asked some NZPFU members to engage in a survey on a potential redevelopment of the Uniform Matrix.

This has been done without any consultation with the NZPFU, and I have responded by lodging a dispute under the CEA.

CODE OF CONDUCT UPDATE

The NZPFU has filed an application in the Employment Relations Authority (ERA) challenging FENZ’s right to impose the Code of Conduct on NZPFU members and challenging the content of that Code.

KIWISAVER DEDUCTIONS AND TAX UPDATE

As the National Council members toured the AGMs over the past few weeks the issue of the calculation of the kiwisaver deductions and relevant taxes was raised by those who have been contribution to a complying Kiwisaver scheme as well as a non-compliant Superannuation Scheme such as FireSuper.

NZPFU NOTIFIES ANOTHER FAILURE TO CONSULT

FENZ is consistently refusing to consult the NZPFU in accordance with the NZPFU collective employment agreement. The NZPFU collective agreement requires FENZ to consult on whether change should occur, not just the content of the proposed change and they must provide the reasoning behind the change and be motivated by a desire to reach consensus.

Failed Mediation for Papakura Senior Station Officer Proposal

Members may be aware that the Local has raised a dispute around the way FENZ’s wants to transition Papakura Station to a Senior Station Officer Station.   This proposal would directly impact 10 personnel and indirectly impact over 120.

Last week the NZPFU provided the advice received from our lawyer regarding the options FENZ has put to 592 members who have been contributing to complying Kiwisaver schemes as well as other non-complying compulsory schemes such as Fire Super.

FENZ REFUSES COMMUNICATION CLAUSE IN BARGAINING PROCESS AGREEMENT

The Bargaining Process Agreement (BPA) is supposed to set out agreements on how the parties will conduct the bargaining but FENZ refused to agree to include a clause that would prevent the harm FENZ caused in the last round through their anti-NZPFU membership tactics of sending offers, their analysis of NZPFU claims and false information to all and sundry.

AMBULANCE OFFICERS STRIKE ACTION

Hato Hone St John Ambulance Officers who are members of First Union and the Ambulance Association (NZAA) have given notice of an intention to withdraw their labour on the 20^th and 24^th August.  The notice is for a four-hour strike from the 4am start of shift on the 20^th August to be repeated on the 24^th August.

MICROPHONES ON MOBILITY TABLETS TO BE DISABLED

FENZ acted swiftly upon the NZPFU notification yesterday that microphones had been enabled on the mobility tablets causing serious concern of possible unlawful surveillance and breaches of privacy.

DISABLE MICROPHONES ON MOBILITY TABLETS

The NZPFU has been informed by members that the microphones on mobility tablets have been activated.  The NZPFU has not been provided with any prior warning of the activation of this function or any lawful purpose for doing so.

Firstly, it has been an absolute honour to have been elected twice by you into the position of President and before that, Vice President. It has been a pleasure to represent you all and advocate and strive for better working conditions, better engagement, and representation across the organisation.

Life and income protection insurance reimbursements for policies other than the NZPFU Protect policy

The NZPFU has provided all necessary information to FENZ for the reimbursement of the NZPFU Protect Income Protection Insurance premiums paid directly to the NZPFU insurance account between 1 July 2023 and 3 June 2024 (when FENZ commenced direct payment to Protect).  Members in the NZPFU Protect Income Protection scheme do not need to do anything further.  We are waiting for FENZ to confirm when the reimbursement will be made to the bank account you receive your wages.

NZPFU FENZ NEGOTIATIONS COLLAPSE

The NZPFU and FENZ were supposed to be bargaining today and yesterday but spent the time negotiating terms of a Bargaining Process Agreement. The parties had met in mediation on Friday to try and settle the BPA and kept working on outstanding issues this week.

Last night at approximately 6pm the parties had worked through almost all issues. The Union recorded and read out to the parties the three issues of work that was to be done by FENZ overnight for completion today which was agreed by everyone in the room. FENZ did not state they had other issues to revisit.

The NZPFU has instructed specialist legal support for advice on the Kiwisaver employer compulsory contributions issue.

The NZPFU will shortly be providing FENZ with the list of NZPFU members who signed up to the NZPFU Protect Income Protection Insurance for the reimbursement of premiums.

FENZ OWES NZPFU MEMBERS MILLIONS IN UNPAID WAGES AND UNPAID KIWISAVER CONTRIBUTIONS

On Tuesday FENZ Workplace Relations Manager Michael Stevenson informed the NZPFU that FENZ had self-reported to IRD its failure to pay the 3% compulsory contribution to employees who have Kiwisaver and other non-complying superannuation scheme such as FireSuper. FENZ had been paying the employer contribution into FireSuper but not the compulsory contribution to the Kiwi Saver Account. We were informed 592 NZPFU members were affected and for all affected staff about $8-$10 million was owing over four years.

If members receive a summons or are informed they will be summonsed,  members are advised to contact the NZPFU and we will ensure you have the appropriate legal advice. 

NZPFU PUT FENZ ON NOTICE PROPOSED CHANGE IN VSO STATUS UNLAWFUL

Without any discussion or consultation with the Union and the individuals concerned, FENZ has unilaterally decided to advertise VSO roles that FENZ characterises incumbent’s as secondees. There has been no discussion with the NZPFU as to the reason or purpose for the change, or the appointment process.

Notice to Wellington Local Members

From 3 June 2024 FENZ will pay the NZPFU Protect Income Protection Insurance premiums direct for NZPFU members whose substantive positions are covered by the collective employment agreement. 2024 BARGAINING UPDATE

The NZPFU has initiated bargaining in accordance with the requirements of the Employment Relations Act 2020. The current collective agreement expires 30 June 2024 but remains in force.

RETURNING OFFICER’S NOTICE TO NORTHCOM UNION MEMBERS

Nominations are hereby called for a Northcom Union Member to be nominated and elected to the Auckland Local Committee, in accordance with the Rules of the New Zealand Professional Firefighters Union.  Only Northcom Union Members are eligible to stand and vote for this position and once a member is elected, Northcom members, in future elections, will only be able to vote for this position and not other Union Committee positions, although Northcom Members can stand and vote for President, Vice President and Secretary in the normal election cycle.

Loafers Lodge Anniversary and criminal trial update

The NZPFU has been in discussions with FENZ management to ensure our members are supported and appropriately assisted through the upcoming Loafers Lodge Anniversary and the criminal trial. Below are the issues we have discussed. If there are other issues members are facing or individual circumstances they can also be accommodated on a case by case basis. We are confident that FENZ is focused on the wellbeing of our members and to ensure our members are appropriately released and supported through the criminal trial.

The second of the Movember-funded wellbeing survey is well underway and due to be closed on 2 April 2024.

Refusal of FENZ to Honour Travel Time Agreement

SERIOUS HOSE FAILURE NOTIFICATION

Members are advised that during a 5^th alarm response in Auckland a serious near miss occurred while deploying lengths of 90mm Fireflex stainless banded hose from the hose layer. Lengths of the hose failed with the coupling coming off under pressure leaving the hose flailing about.

MEMBERS ADVISED NOT IN YOUR INTERESTS TO RESPOND TO NEW CODE OF CONDUCT

On Thursday afternoon FENZ verbally informed the NZPFU that a new code of conduct would be distributed organisation wide today for feedback. The NZPFU immediately objected on the basis that the  code of conduct sets out the standards on which disciplinary action including dismissal can be determined. The security of employment and income is one of the most basic and serious terms of employment for employees.

President's Blog: Heads up 26

It’s been a while since my last blog, and deliberately so as everyone is suffering some form of fatigue, whether it be working, struggling with payroll issues and post negotiation fatigue, I know it took a lot out of us all. I know I’m feeling it as the year came to an end and the new year starts.

Wishing you all a safe and relaxing festive season

At this time of year our thoughts are with our members who selflessly leave their families and friends to celebrate the season while they work to protect and serve the community. It is a reality of the job that our members are rostered on public holidays and weekends. We acknowledge and appreciate the families and friends who accept that reality and adapt celebrations and traditions to fit in with rosters.

Following a trial taken in Auckland Central District, and in the interest of providing Firefighters with consistent and quality post fire management, both Counties Manukau and Waitemata Districts have undertaken to rollout Post Fire Management Capability in their Districts. This resource has been funded locally at the request of the Auckland Local.

Loafers Lodge Affidavits

Post the Loafers Lodge fire the NZPFU organised a lawyer to assist members to draft affidavits that could be provided for any internal or external inquiry into the matter. It was obvious there would be coroners hearings, likely criminal charges and various inquiries including a FENZ review. We wanted to ensure our members could collate their information as soon as practicable to the event into an affidavit that could be presented in any inquiry or legal forum. We also wanted to mitigate the harm caused when having to repeatedly recall in detail involvement in traumatic events such as the Loafers Lodge fire.

The Northern Drivers’ Charitable Trust is offering a scholarships to assist union members or their families to assist with training or re-training in any trade, skill or tertiary study.

Employees cannot be compelled to participate in employment investigations

Various NZPFU members have been reporting receiving emails containing a “lawful directive” to participate in employment investigations.  The implication of the email is that those that refuse to participate may be subject to disciplinary action themselves for failing to comply with the “directive”.

WHANAUNGATANGA WELLNESS SURVEY REPORT IS GRIM READING

The Report of the Whanaungatanga Wellbeing Survey is grim reading with nearly one in three career firefighters meeting the criteria for one or more mental ill health indicators and Communication Centre dispatchers reporting this highest rates of mental health issues when compared to other roles in the organisation. In addition to the exposures to trauma through emergency response, the survey found only 6.6% career firefighters felt supported by FENZ as an organisation.

Update on Payroll issues, Income Protection Insurance and reimbursements, and Industrial Officer

Members have a range of issues from queries to known errors in their pay and back-pay.  I met with relevant FENZ management late last week to get a picture of what was happening and timelines for resolution.

Psychological Support and Supervision Pilot Launched

An important part of 2023 settlement of the collective agreement - the NZPFU initiated Psychological Support and Supervision Pilot – is now underway.

NZPFU WINS HOLIDAY PAY CASE IN EMPLOYMENT COURT

The Employment Court has agreed with the NZPFU position that firefighters should be paid 1.5 times the overtime rate for the hours worked on overtime on a public holiday. FENZ has only been paying 1.5 times the ordinary hourly rate resulting in firefighters working overtime on public holidays only being paid the same as those working their usual hours and not on overtime.

Celebrating 40+ years of women career firefighters

The NZPFU is hosting an event to celebrate 40 plus years of women career firefighters with special  tributes to Anne Barry and Elizabeth England who were the first women career firefighters in New Zealand and the Commonwealth. Anne Barry battled for the right to transition from the communications call centre to career firefighting taking her case to the Human Rights Commission, the Equal Opportunities Commission and to Parliament before finally being accepted in 1981 on the career recruits course with Elizabeth England.

Loafers Lodge Remembrance Service

A Service of Remembrance for those that lost their lives or were impacted by the tragic Loafers Lodge fire will be held this Thursday.

FENZ ASBESTOS MANAGEMENT PLANS CANNOT BE RELIED UPON

Worksafe has issued FENZ with a notice requiring FENZ to review all Asbestos Management Plans (AMPs) to ensure they are implemented, monitored and effective.  The Provisional Improvement Notice (PIN) refers to ALL AMPs which means it applies to all FENZ owned/leased/occupied/used buildings across the country.

The tragic fire at Loafers Lodge last Monday will result in various internal and external inquiries including police investigations, criminal charges, coronial inquiries and FENZ operational reviews and investigations.  NZPFU members want to ensure that the loved ones of the deceased get the answers they need.  It is important that the full picture is presented to the various inquiries, and that information is accurate and provided in context.

MESSAGES OF SUPPORT FOR THOSE AFFECTED BY THE WELLINGTON HOSTEL FIRE

It was with a heavy heart that many of us woke this morning to the news of the tragic hostel accommodation fire in Wellington. We send our deepest sympathy to the loved ones of the deceased, those injured and those that survived unscathed but have lost their home and friends. We understand there was a sense of community in the Loafers Lodge hotel in Newtown and the impact will be felt by many.

Whilst Auckland and Northland firefighters, both career and volunteer, are facing yet another 1 in 100 year flood this year, it is apparent that climate change is here to stay. We need to ensure we adapt and remain vigilant to ensure that safety remains paramount for both the public of New Zealand and us as rescuers.

More than 12 years after the tragic 22 February 2011 earthquake the 7^th and last fire station re-build will be celebrated with the official opening of the Christchurch City Station.

INCOME PROTECTION INSURANCE UPDATE

The NZPFU is currently in discussions with two providers for income protection insurance for members. This process has taken far longer than we envisaged and much of the delay stems from the impact of extreme weather events on insurance companies. The NZPFU National Committee is committed to ensuring we have procured the most effective policy for members and is carefully considering either option.  We expect to be able to make an announcement shortly.

CONFIRMED DISTURBED ASBESTOS DURING RENOVATION OF AUCKLAND CITY STATION

The NZPFU has commissioned independent specialist advice and testing as a result of the confirmed presence of asbestos during renovations at Auckland City Station yesterday.

3 MAY FOR BACKPAY

FENZ has confirmed the backpay for the NZPFU members covered by the collective employment agreement will be paid on 3 May 2023.  At the time of ratification it was indicated that the backpay would be paid in the first pay in May.

It is with great sadness that we inform members that NZPFU life member Jack Glassford (formally of the Gisborne Local) passed away after a short illness on Tuesday morning.

Type 3 acquisition project probity requirements

The type 3 acquisition project is entering stage 4 of the project which includes operational user evaluation of the appliances at selected fire stations. The trial will generate lots of interest. The suppliers are in competition and must have a level playing field. Any public comments could cause a supplier to take legal action resulting in considerable delay for the project.

NZPFU SEEKS COMPLIANCE WITH HOLIDAYS ACT PAYMENTS

In a decision released in August 2022 the Employment Relations Authority determined that NZPFU members working overtime on a public holiday must be paid 1.5 times that overtime rate as that is the rate for the calculation of the relevant daily pay.

A devastated family and community are reeling with the death of the second volunteer firefighter caught in a landslide in Muriwai.

Yesterday afternoon the battle to locate a volunteer firefighter trapped under a landslide concluded with the recovery of his body at Muriwai.

UNTENABLE EARTHQUAKE RISK AT TAURANGA FIRE STATION - FENZ MUST ACT NOW

For a decade FENZ (and its predecessor NZFS) has known the Tauranga Fire Station only has an 18% NBS earthquake rating with firefighters accommodated in the proximity of the most compromised structural wall. For years the NZPFU Local has been battling for progress and relocation while the station is strengthened to at least the required 67% NBS or demolished and built on a suitable site. There have been other investigations including a 2020 visual assessment of the cracks in the building but FENZ has yet to act on the various recommendations.

RELEASE OF PEOPLE RE-SET CONSULTATION

Today FENZ has released an amended People Re-set consultation document that does not address key issues the NZPFU has raised with FENZ.

Last nights unprecedented weather event caused widespread havoc across the region with Fire and Emergency career and volunteer crews, operational support and 111 emergency dispatchers working to exhaustion, with all available FENZ resources at times being mobilised to incidents right across the region.

CIVIL DEFENCE EMERGENCY PAYMENTS

NZPFU members worked tirelessly throughout the night responding to the unprecedented flooding within the Auckland Region. More than 2000 calls slammed the emergency call centre dispatchers.  All fire crews were deployed preforming rescues from homes and vehicles hampered by the torrential rain and rising flood waters making some roads and motorways unpassable.

BE WARY OF FREE PERSONALITY ASSESSMENTS

The NZPFU has become aware of FENZ offering “free personality assessments” from one of their “Partners” who are reportedly “introducing new psychology tools to the market”. The invitation is actually to take place in research and be part of data collection.

Due to the vote to ratify the collective agreement all current and proposed industrial action, including the omnibus of bans, now ceases from 0800 today.

RATIFICATION ROMPS HOME WITH 97.7% VOTING FOR THE AGREEMENT

NZPFU members turned out in force across the country to vote to accept the proposed settlement of the 2021-2024 collective agreement as recommended by the Union’s National Committee.

FENZ FAILS IN ITS BID TO STAY THE HOLIDAYS ACT PAYMENTS

In August we notified members that the Employment Relations Authority had determined that firefighters working overtime on a public holiday must be paid 1.5 times the overtime rate as the overtime rate is the relevant daily pay.

Ratification Meeting next Tuesday 13th Dec at 5pm

As you will be well aware by now, we have finally reached an agreed term of settlement in the negotiation for a new CEA. The NZPFU is recommending members accept it and ratify the settlement offer. The National Committee has completely wrung out the sponge for every possible drop of benefit to members, and it's now our turn to act.

SIGNIFICANT SETTLEMENT OFFERED TO NZPFU MEMBERS

Christmas cheer may have come a little earlier for NZPFU members with the NZPFU National Committee today releasing and recommending ratification of a proposed settlement with FENZ. After 18 gruelling months of negotiations and six months of industrial action including all NZPFU members walking off the job twice, the NZPFU members have just received the detail of the proposed settlement that the NZPFU recommends members’ accept.

The NZPFU national committee determined today to cancel Monday’s strike while Government considers increasing the necessary funding to settle the collective agreement negotiations. The parties are asking the Government to increase the proposal it made a couple of weeks ago.

The NZPFU and FENZ received Graeme Colgan’s final Report with recommendations for the way forward in collective agreement negotiations this afternoon.  The report was the result of a mediated facilitation process agreed with the Minister Jan Tinetti.

PARNELL LADDER MOVES TO HAMILTON

Parnell firefighters watched their life saving aerial appliance leave Auckland for Hamilton today. The move comes after Hamilton's aerial went offline for servicing. Parnell firefighters have been left to crew a salvage truck. Just one heavy aerial remains to protect Auckland.

Brakes fail on another Christchurch fire truck

Redwood, Christchurch was left without their fire truck today after the truck's brakes failed. The 15 year old truck almost caught fire returning to station following a callout. The community was without a fire truck for 3 hours. A 24 year old vehicle has been commissioned to replace it.

Auckland Career Fire Stations Close Due to Lack of Staffing

Further to our notice of 9th January, career fire stations and fire trucks continue to face crisis levels of staffing, with several stations closed during the day due to a lack of career firefighters, with many more fire trucks responding to emergencies with below the minimum safe number of firefighters.

No Hamilton aerial coverage

The continued lack of planning, procurement and management of aerial appliances continues to put our communities at risk. For most of this week, Hamilton and the greater Waikato area will be without the heavy aerial Snorkel and its relief as the snorkel will be undergoing its scheduled service and repair work which takes the appliance off the road for at least 3 days.

NZPFU unvaccinated members affected by the mandatory vaccination order now have the choice of Pfizer or AstraZeneca vaccinations. This week the Government announced those covered by a mandatory vaccination order and those that were advised not to have the Pfizer vaccine on medical grounds will be given priority.

All FENZ personnel covered by the mandatory health order must have at least the first dose of the Covid-19 vaccination before 29 November 2021 and second dose by 14 January 2022 to continue working in their roles.

GOVERNMENT GRANTS TWO-WEEK REPRIEVE FOR VACCINATION DEADLINE

FENZ has been granted a two-week extension to the implementation of the COVID-19 Public Health Response (Vaccinations) Amendment Order (No 3) 2021.

Paid special leave for unvaccinated workers to be consulted

FENZ has determined it will pay up to two weeks’ paid special leave from the 16th November 2021 for declared unvaccinated workers covered by the mandatory health order. That paid special leave is on the condition the employee actively engages in consultation about any alternative duties and options during that period.

We have still not received any confirmation from Government of the scope and impact of any pending mandatory vaccination orders. This afternoon Minister Chris Hipkins announced a Cabinet decision to require teachers and most healthcare workers to be Covid-19 vaccinated. The Minister specifically referred to a range of roles in the health sector including paramedics but firefighters were not mentioned.

TFT 25mm GForce Hosereel Nozzle Recall

It has been brought to the Auckland Local’s attention that it has been discovered that the TFT 25mm Gforce hosereel nozzles are designed to a European specification, which is for low pressure nozzles, and have a maximum working pressure of 16 bar (1600 kPa) instead of the hose reel pressure version specified at 40 bar (4000 kPa).

Proposed ACC changes do not go far enough to ensure Firefighter's occupational disease recognised

The Government has announced proposed changes to ACC that will impact on firefighters’ occupational disease and cancer claims but does not go far enough.

Transfers and vacancies

Members have reported some Managers are intending to apply the transfers and vacancies policy across the new larger districts. Managers cannot unilaterally impose this change. There are provisions in the NZPFU collective agreement that must be considered and applied.

It’s been a minute, firstly, I feel extremely privileged to have been re-elected as President for the NZPFU. VSOs workloads must be reasonable

The NZPFU has confirmed with the National Commander that VSOs are not to be expected to pick up additional workloads when Tranche 2 stands up next month. Unreasonable workloads are a health and safety issue.

FENZ spends more than $175,000 and three years on investigation that has yet to be completed

In April this year an investigation into complaints made by firefighters against management behaviour at one station ticked over its three year anniversary. By 30 April this year FENZ had spent $174,428.39 excluding GST on the investigation – more than $162,000 was paid to the investigator and $11,662 spent on staff travel and accommodation.

New statutory minimum sick leave entitlement

The Holidays (Increasing Sick Leave) Amendment Act 2021 comes into effect tomorrow (24 July 2021) increasing the statutory minimum of 5 day’s sick leave to 10 days per year. Affected employees will get the additional 5 days when they reach their next leave entitlement date. Employees who already get 10 days or more sick leave are not affected by this legislative change.

This week, Auckland City 206 was removed from service due to a driveshaft issue. Parnell 255 has been away for repair for an extended period. This leaves Auckland with only one 24-year-old “heavy” aerial appliance.

FENZ MUST IMMEDIATELY CEASE FUNDING UFBA AND DECLARE NO CONFIDENCE IN UFBA BOARD

On the 6^th January 2021 the UFBA Board Chair publicly announced the reinstatement of the UFBA CE after abandoning the investigation into allegations including sexual assault. On the 14^th January 2021 the NZPFU wrote to the FENZ Board asking whether the Board considered it appropriate to continue to fund the UFBA, and whether FENZ had any concerns about the continued operation and funding of the UFBA in these circumstances.

This week FENZ has required black watch trainers to interrupt their duties to staff a truck and respond.  There have also been recent instances where FENZ has cross-crewed professional career firefighters and volunteer firefighters on a tanker or volunteer appliance (where there has not been any prior arrangement or agreement to do so).

Pay increase update

FENZ has notified the NZPFU that they will be uploading and testing the new pay rates from mid-January for the new pay rates to be paid on 10 February (backdated to 1 July 2020).

FENZ Deputy CE Organisational Strategy & Capability Development Russell Wood has provided an update on the repair of the MAN Type 3 trucks waiting repairs for the cracks issues but was unable to provide any timeline or clear solution.

Shift start/finish times

One of the ideas that came up during the Auckland Working Group was to change the shift start/finish times to 0700/1700 to reflect the actual times Auckland Firefighters’ work.

Ambulance Officers give strike notice

St John Ambulance FIRST union members have given notice of a 24 hour strike to be held on 25 November 2020. The notice of strike action comes after St John has continued to withhold their agreed shift pay, is proposing salary cuts to fully funded jobs, and wants to remove their rosters from the Collective Agreement.
